Terms and Conditions
Last Updated: 04/10/2026
Welcome to Eliteorofacialsolutions.com (the "Website"), operated by Elite Orofacial Solutions ("we," "us," "our," or the "Company"). These Terms and Conditions ("Terms") govern your access to and use of the Website, any related mobile applications, services, content, and features (collectively, the "Services").
By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or Services.
1. Use of the Website and Services
The Website provides information about orofacial myofunctional therapy, related educational resources, and may facilitate booking or delivery of myofunctional therapy services (including assessments, exercises, telehealth sessions, or programs).
-
Educational Content Only: Materials on the Website (articles, videos, blogs, resources) are for general informational and educational purposes. They are not a substitute for professional medical, dental, or therapeutic advice, diagnosis, or treatment.
-
No Therapist-Client Relationship: Mere use of the Website or reading content does not create a therapist-client relationship. A formal relationship only arises after you schedule and begin services with a qualified provider, following applicable informed consent processes.
-
Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services independently. Minors may use the Services only with the involvement and consent of a parent or legal guardian.
2. Myofunctional Therapy Services
If you engage our myofunctional therapy services (in-person, virtual/telehealth, or hybrid):
-
Services involve exercises and techniques to address orofacial myofunctional disorders, such as improper tongue posture, swallowing patterns, breathing habits, and related issues.
-
No Guarantees: Outcomes vary by individual factors (compliance with exercises, underlying conditions, age, etc.). We do not guarantee specific results, symptom resolution, or improvements in sleep, speech, dental alignment, or any other condition.
-
Consultation with Professionals: Myofunctional therapy is often complementary to care from dentists, orthodontists, ENT specialists, sleep physicians, or other healthcare providers. You should consult your qualified healthcare professionals before starting, especially if you have medical conditions, recent surgeries, or concerns.
-
Telehealth: Virtual sessions may be offered where legally permitted. You are responsible for ensuring a private, secure environment and a stable internet connection. Telehealth has inherent limitations (e.g., no physical examination). In emergencies, contact local emergency services immediately.
-
Informed Consent: Before services begin, you will receive and must acknowledge an informed consent document detailing risks, benefits, alternatives, and expectations. Participation confirms your understanding and voluntary consent.
3. User Accounts and Responsibilities
-
If you create an account or book services, you must provide accurate, current information and keep it updated.
-
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
-
You agree not to use the Services for any unlawful purpose, to harass others, or to upload harmful content (viruses, etc.).
4. Intellectual Property
All content on the Website (text, images, videos, exercises, logos, materials) is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.
-
You may view and use content for personal, non-commercial purposes only.
-
You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.
-
Any exercises or programs provided as part of services are for your personal use only and may not be shared or resold.
5. Payments, Cancellations, and Refunds
-
Fees for services are as listed on the Website or quoted at booking. We reserve the right to change prices with notice.
-
Payments are processed securely. By providing payment information, you authorize charges.
-
Cancellation Policy: Short notice cancellations or missed appointments significantly affect our practice, often leaving us with appointment slots that are unable to be filled.
-
We understand that situations and circumstances can often arise unexpectedly, and we try to be as accommodating as possible, however, we ask that you please provide us with at least 48-hour advance notice whenever possible. For any appointments that are cancelled or changed within less than 48 hours of notice, as well as any missed appointments (no-shows), it will count against your total program sessions, or a cancellation fee of $50 will be applied
-
Refunds: No refunds will be given at any point during treatment. $150 comprehensive evaluation fee is also non-refundable. If you no show you forfeit that deposit.
6. Disclaimers and Limitations of Liability
-
No Medical Advice: The Website and Services do not provide medical, dental, or diagnostic services. Nothing herein replaces evaluation or treatment by licensed professionals. Always seek advice from your physician or qualified provider for health concerns.
-
Use at Your Own Risk: You assume all risks related to your use of the Website and Services, including any exercises performed. We are not liable for any injury, discomfort, or adverse effects resulting from following information or exercises on the Website or during services (unless caused by our gross negligence or willful misconduct, as determined by a court).
-
No Warranties: The Website and Services are provided "as is" and "as available" without warranties of any kind (express or implied), including accuracy, completeness, timeliness, or fitness for a particular purpose.
-
Limitation of Liability: To the fullest extent permitted by law, the Company, its owners, therapists, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of the Website or Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if no payment was made).
-
External Links: We may link to third-party sites (e.g., referral partners). We are not responsible for their content, privacy practices, or services.
7. Privacy and Data
Your privacy is important. Please review our Privacy Policy [link] (and HIPAA Notice if applicable), which explains how we collect, use, and protect your information. By using the Services, you consent to our data practices.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
-
Your violation of these Terms;
-
Your use of the Website or Services;
-
Any content you submit; or
-
Your interactions with third parties.
9. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason (including breach of these Terms). Upon termination, your right to use the Services ceases, but certain provisions (disclaimers, liability limits, indemnification) survive.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state of Missouri, without regard to conflict of laws principles.
Any disputes shall first attempt informal resolution. If unresolved, disputes will be resolved exclusively in the courts located in Buchanan County Missouri. You waive any objections to venue or jurisdiction there.
